Why isnt ticket scalping illegal

When ticket scalping laws are broken, consequences are often not enforced. As with crime in general, police officers handle the offense according to severity. Scalping is a nonviolent crime without a victim — in fact, it is a crime where both parties are agreeable to the transaction. Therefore, cops are often hesitant to get involved. In addition to state laws, other laws make scalping illegal in raceways and the NFL.

Those who can enforce the law at races or football games include box office personnel, supervisors, venue managers, ticket agents, security agents, event promoters and seat holders. At other events, reselling tickets is not illegal, but it's not permitted on stadium grounds. This is why scalping often occurs in close proximity to events, such as concerts or baseball games, but not within the grounds or stadium.

Laws became even more difficult to enforce when the practice became widespread online. If the official website for the event sells out, these sites promote themselves as a second chance. Efforts to make the practice illegal are overshadowed by such websites. Those in favor of the legality of ticket scalping say that going through brokers creates a safe and reliable way to get tickets.

If tickets to a popular show go on sale on Tuesday at 10 AM —what about those of us who work and cannot line up, phone, or log on to TicketMaster? Why am I penalized because I have a job and cannot take time off to try to get tickets?

How fair is it that in order to get a good shot at Red Sox tickets, I have to fork over thousands of dollars for season tickets? Is that really all that bad? Rock Stars: If you are worried about scalping to fans that are dying to see your show, add another night or play a larger venue.

Massachusetts Government. Why Is Ticket Scalping Illegal? Posted on April 10th, 5 Comments. Scalping tickets by resellers such as stubhub or Ace tickets is worng and unfair. Why do they have the right to buy up all available single game tickets before they go on sale to the public and then charge triple their face value? To me, it is a VERY big deal.

From Richard A. Pacheco on May 12th, I think the anti scalping laws are bogus!!! As a season ticket holder who dishes out thousands of dollars to have MY seats for the season as wellas the right to buy playoff tickets paid upfront!!! They have fees added on top of the "face value". From David on October 5th, scalping is illegal and should continue to be illegal because you don't own anything, the ticket, the seat remain the property of the venue.

So the right to sell another product does not apply.
